1.Who we are

Kindloom Labs is an AI education and resources brand operated by Kindloom LLC, a New Jersey limited liability company.

Throughout these Terms, "Kindloom," "we," "us," and "our" refer to Kindloom LLC.

2.Eligibility

You must be at least 18 years old to create an account or make a purchase.

By using the site, you represent that you are able to enter into a binding agreement.

3.Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You agree to provide accurate information and to update it as needed. Notify us immediately of any unauthorized use at hello@kindloomlabs.com.

4.Library membership & subscriptions

The Kindloom Library is a paid subscription providing access to tutorials, prompt packs, guides, templates, and periodic resource drops. Contents may change over time as resources are added, updated, or retired.

Subscriptions are billed in advance through Creem, our Merchant of Record, at the price shown at checkout. Founding-member pricing, where offered, applies as described at the time of purchase.

Subscriptions renew automatically at the end of each billing period until cancelled. You may cancel anytime through your account, the Creem customer portal, or by contacting us. Cancellation takes effect at the end of the current period — you retain access until that date.

We may change pricing on a going-forward basis with reasonable notice. Price changes do not affect a period you have already paid for.

5.Digital product license

Purchases and Library resources are licensed for personal or internal business use by the account holder. This license is limited, non-exclusive, non-transferable, and revocable.

You may not: resell, redistribute, sublicense, or share resources or your account; publish resources publicly or where they may be freely downloaded; or use our resources to build a competing product or library.

6.Refunds

Refunds are handled as described in our Refund and Cancellation Policy, which forms part of these Terms.

7.Acceptable use

You agree not to: use the site for any unlawful, harmful, fraudulent, or infringing purpose; attempt unauthorized access to other accounts or systems; interfere with or disrupt the site; scrape or harvest content beyond what these Terms permit; or upload or transmit malware.

We reserve the right to suspend or terminate access for violations.

8.Intellectual property

The site and its content — including text, graphics, logos, the 'Kindloom Labs' name, prompts, guides, templates, and code — are owned by us or our licensors and protected by copyright, trademark, and other IP laws. Except for the license above, no rights are transferred to you.

9.AI & informational content

Our resources are educational and informational. They are not professional legal, financial, tax, or medical advice. You are responsible for reviewing and validating anything you create using our resources, including output from third-party AI tools. See our full Disclaimer.

10.Third-party services

The site may reference or link to third-party tools, platforms, and AI providers. We do not control or endorse them and are not responsible for their content, terms, or practices.

Payments and tax are handled by Creem as our Merchant of Record. Transactions are subject to Creem's terms.

11.Disclaimers & limitation of liability

The site and resources are provided 'as is' and 'as available,' without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Kindloom Labs and its owners, members, and contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.

Our total aggregate liability for any claim will not exceed the amount you paid us in the twelve months before the claim. Some jurisdictions do not allow certain limitations — where prohibited, they do not apply.

12.Indemnification

You agree to indemnify Kindloom Labs, its owners, members, and contributors from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the site, your violation of these Terms, or your infringement of third-party rights.

13.Termination

We may suspend or terminate your account for violation of these Terms. You may stop using the site at any time. Provisions that by their nature should survive termination — including IP, disclaimers, liability limits, indemnification, and governing law — will survive.

14.Governing law & disputes

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.

Any dispute will first be resolved through good-faith informal negotiation. If that fails, the dispute will be resolved exclusively in the state or federal courts located in New Jersey, and you consent to personal jurisdiction in those courts.

To the fullest extent permitted by law, claims must be brought individually and not as part of any class, collective, or representative proceeding.

15.Changes to these terms

We may update these Terms from time to time. Material changes will be communicated by email or a notice on the site. Continued use after changes take effect constitutes acceptance.
